Maternity Benefit is a mandatory entitlement under the Maternity Benefit Act, 1961 (amended in 2017) that requires employers to provide paid leave, medical bonuses, and job protection to female employees during pregnancy, childbirth, and post-natal recovery. The 2017 amendment significantly expanded the original 1961 Act:

Maternity benefit is paid at the rate of the employee’s average daily wage for the period of absence:

Example: An employee earning ₹60,000/month (average daily wage = ₹2,000) receives ₹3,64,000 for the full 26-week period (₹2,000 × 182 days).
For employees covered under ESI (gross wages ≤ ₹21,000/month), maternity benefit is paid by the ESI Corporation at 100% of average daily wages for 26 weeks. The employer’s obligation shifts to ensuring ESI contributions are current.
