What Is Maternity Benefit?

Maternity Benefit is a mandatory entitlement under the Maternity Benefit Act, 1961 (amended in 2017) that requires employers to provide paid leave, medical bonuses, and job protection to female employees during pregnancy, childbirth, and post-natal recovery. India’s maternity benefit provisions are among the most generous globally.

How It Works Under the Maternity Benefit Act 2017

The 2017 amendment significantly expanded the original 1961 Act:

Eligibility

  • Must have worked at least 80 days in the 12 months immediately preceding the expected delivery date.
  • Applicable to establishments with 10 or more employees.
  • Covers all female employees regardless of designation or salary level.

Payment Calculation

Maternity benefit is paid at the rate of the employee’s average daily wage for the period of absence:

Example: An employee earning ₹60,000/month (average daily wage = ₹2,000) receives ₹3,64,000 for the full 26-week period (₹2,000 × 182 days).

Additional Employer Obligations

  1. Work from home — Employer may allow work from home after 26 weeks if the nature of work permits.
  2. Crèche facility — Mandatory for establishments with 50+ employees. Mother permitted 4 daily crèche visits.
  3. No termination — Dismissal or discharge during maternity leave is illegal and punishable.
  4. No deduction — Employer cannot reduce wages or benefits during the leave period.

ESI-Covered Employees

For employees covered under ESI (gross wages ≤ ₹21,000/month), maternity benefit is paid by the ESI Corporation at 100% of average daily wages for 26 weeks. The employer’s obligation shifts to ensuring ESI contributions are current.
